Although the Mental Health Act was passed by Parliament in 2001, it only came into operation much later in 2010 when the Mental Health Regulations also came into force. Broadly, the Mental Health Act provides two ways in which an individual can be admitted into a psychiatric hospital:

Under section 52 of the Mental Health Act 2001 (“ Mental Health Ac t”), the court has the power to order an inquiry to determine if because of a mental disorder, a person is incapable of managing himself and his affairs.

May 23, 2023 · KUALA LUMPUR: The Dewan Rakyat has passed amendments to the Mental Health Act 2001. The amendments under the Mental Health Act (Amendment) 2023 were made following the decriminalisation of suicide under the Penal Code (Amendment) (No. 2) Bill 2023 on Monday (May 22).
