Oct 29, 2020 · Tan Ying Hong. Nearly a decade after the controversial decision above, the Federal Court was given an opportunity to review its decision in Adorna Properties, via the case of Tan Ying Hong. Mr Tan (Appellant) was the registered owner of a piece of land in Kuantan.
Tan Ying Hong only became aware of the existence of this land when he received a letter from United Malayan Banking Corporation Bhd (now RHB Bank) in 1985, demanding repayment for RM300,000 being the outstanding loan sum for a loan granted by the bank to a company, Cini Timber Industries Sdn Bhd.
In deciding on the case of Tan Ying Hong v Tan Siang San & two others, the court ruled that transfers of property by fraudulent or forged documents were no longer legally valid under Section 340 (2) of the National Land Code 1965.
